These terms cover your use of Property Track: this website, the Property Track browser extension and Property Track Plus. Property Track is run by Benns Software Ltd, a company registered in England and Wales (company number 15751857) whose registered office is at 71‑75 Shelton Street, Covent Garden, London WC2H 9JQ. In these terms, “we”, “us” and “our” mean Benns Software Ltd, and “you” means the person using Property Track.

By using Property Track you accept these terms, and we ask you to agree to them when you create an account. Our privacy policy explains how we handle your personal data.

Who can use Property Track

You must be 18 or over to create an account or subscribe to Plus. You can use Property Track for yourself or for your work, for example as a buyer, renter, landlord, investor or agent, to inform your own decisions.

The free extension

The price history the extension adds to Rightmove is free and needs no account. The extension works in desktop Chrome, Firefox and Edge. We may change or improve free features over time.

Your account

  • You sign in with a link we email to you, so there is no password. Keep your email account secure: anyone who can read your email can sign in as you.
  • Give your real name, and keep the email address on your account one that you use.
  • An account is for one person. Do not share it, or the sign-in links we send you.

Property Track Plus

Plus is a paid subscription that adds Comparables, Recent sales and Trends to the extension, as described on our pricing page. To use it you need the extension installed and to be signed in. Recent sales and Trends use HM Land Registry data, which covers England and Wales only.

Prices and payment

  • Plus is billed monthly or annually, at the price shown when you subscribe. Prices are in pounds sterling and include VAT where it applies.
  • You pay when you subscribe and then at the start of each billing period. Your subscription renews automatically until you cancel it.
  • Payments are taken by our payment processor. We never see or store your card details.
  • A discount code applies only as described when you use it.

Failed payments

If a renewal payment fails, our payment processor will try again over the following days. Plus is paused until the payment goes through, and if it still cannot be taken, your subscription may end.

Switching between monthly and annual

You can switch from your account page. Before you confirm, you are shown what you will be charged or credited.

Price changes

We may change the price of Plus. If we do, we will email you at least 30 days before the new price applies to you, and it will apply only from your first renewal after that notice. If you do not want to pay the new price, cancel before then.

Cancelling and refunds

You can cancel Plus at any time from your account page. Plus stays on until the end of the period you have paid for and then stops, and you will not be charged again.

14-day money-back guarantee

If Plus is not for you, email us at oliver@benns.co within 14 days of your first payment and we will refund it in full. The same applies to each annual renewal: email us within 14 days of the renewal payment and we will refund that payment. When we refund a payment we end your subscription, and we pay the refund to the card you paid with within 14 days of your email.

This guarantee includes your legal right as a consumer to cancel a new subscription within 14 days. Outside those 14 days we do not refund part of a billing period, except where the law requires it, for example if Plus is not provided as described.

Using Property Track fairly

When you use Property Track, you must not:

  • copy, scrape or download its data in bulk, or access our servers other than through the website and the extension;
  • resell or republish the data it shows you, or use that data to build a competing product or dataset;
  • share your account, or let anyone else use your subscription;
  • get around sign-in, Plus or any limits we set, or disrupt or overload the service;
  • copy, modify or reverse engineer the website or the extension, except where the law allows you to;
  • use Property Track for anything unlawful.

The information we show

Property Track brings together information from public and third-party sources: asking prices from property listings, sold prices from HM Land Registry, and floor areas matched from the register of energy performance certificates. We work to keep it accurate, but it can be incomplete, out of date or wrong. Sales, for example, are registered weeks or months after they complete.

Property Track is for information only. It is not a valuation, a survey, or financial, legal or property advice, and it should not be the only thing you rely on when deciding what to offer, pay or charge. Check anything important with a qualified professional before you act on it.

Property Track is independent and is not affiliated with, endorsed by or connected to Rightmove. Rightmove is a trade mark of its owner.

Our content

The website and the extension, including their design, code and text, belong to us or to those who license them to us. We give you a personal, non-transferable right to use them under these terms. Data from the sources above remains subject to its own licences.

Availability and changes

We aim to keep Property Track running smoothly, but we cannot promise it will always be available or free of errors. Changes to Rightmove or to our data sources can stop a feature working until we fix it.

We may change, add or remove features. If a change significantly reduces what Plus offers, or we stop offering Plus, we will tell you in advance, and you can cancel and be refunded for the part of your billing period you have not used.

Our responsibility to you

If you are a consumer, the law gives you rights when a service or digital content is not as described or is not provided with reasonable care and skill. Nothing in these terms affects those rights.

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill, and not for loss that was not foreseeable. Our total liability to you is limited to the amount you paid us for Plus in the 12 months before the event the claim relates to. If you use Property Track for business, we are not liable to you for any loss of profit, revenue, business, goodwill or opportunity.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude.

Closing your account

You can stop using Property Track at any time. To close your account, cancel any subscription and email us from the address on your account, and we will delete it as our privacy policy describes.

We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal or security reasons. If we close it while you have Plus and you have not broken these terms, we will refund the part of your billing period you have not used.

Changes to these terms

We may update these terms, for example when what Property Track offers or the law changes. The date at the top of this page shows when they last changed. If a change materially affects you, we will email you before it applies, and if you have Plus you can cancel before then. By continuing to use Property Track after a change, you accept the updated terms.

Law and disputes

These terms are governed by the law of England and Wales. If you have a problem with Property Track, please email us first so we can try to put it right. If you are a consumer, you can bring legal proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts where you live.
